usician JRX (Jerinx) from the Bali-based band Superman Is Dead has blasted singer Via Vallen for allegedly covering the band’s song, “Sunset Di Tanah Anarki”, without permission.
With continuous posts on Twitter and Instagram starting on Nov. 9, the drummer first said that Via wouldn’t be where she was without the song. Afterward, replying to a fan’s tweet about Via being a fan of the band, JRX tweeted: “A fan but never once did she ask for permission to cover SID’s song. The song has an enormous meaning. Does Vallen understand that song she sang? It’s not about the money. She’s DEGRADING the meaning of the song.”

Replying to another fan’s comment that the DVD version of the song has been released, JRX said, “Exactly. But then again, money is not my objective. Anyone can cover it AS LONG AS it’s done with good intentions; for history, fellow humans and the future of the nation. If it’s done only to endow oneself, then she’s no different than a f***ing wh***.”

On YouTube there are numerous videos of Via singing the song in concerts since June 2014 in what seemed to be videos made by fans or members of the audience.
In an Instagram post on Nov. 11, Via tried to clarify the matter. “I’d like to apologize to Jerinx should he feel any objection that I’ve been singing the band’s song on off-air stages, along with dangdut music, which he said destroyed the song’s soul,” she wrote.
The singer stated that her performance of the song had never been officially recorded and distributed by her record label. “I do know that several organizers have documented my performance in videos. My job is to sing on stage and as far as I know any documentation of the song is for the organizers’ private collections. I have no knowledge whatsoever about them being commercialized through VCD or YouTube,” she added.

In a post on Nov. 11, JRX said that his ultimate objection was that he considered Via had used and degraded the song merely for fame. “I won’t ask for a dime from VV or other singers who have or still make a living out of SID’s songs. I just wish you could be wiser in dealing with our music,” he wrote.
Music observer and Music Biz: Smart Manual to Know the Music Business author Wendi Putranto said that if Via had not asked for permission from the songwriter or publisher for singing SID’s song on a commercial stage, she had violated Copyright Law No. 28/2014.
“For a public performance of a song, whether it’s a cover or played in a commercial place or event in which the singer receives an income, then ideally and according to the Copyright Law, he/she must deal with the license and pay for any performing royalty,” he said, adding that the performing right royalty concept has still to be fully grasped by the Indonesian public, including in show business.
In regard to JRX’s allegation that Via has released the song via DVD or VCD, Wendi said that Via is not to be blamed since it has not been confirmed whether it is an official release. (wng)
