Be prudent implementing Internet law: MK chief

The Constitutional Court chief has urged judges, prosecutors and the police to be prudent in enforcing the 2008 Law on Electronic Information and Transactions (ITE) against a housewife, Prita Mulyasari, who is accused of libel for sharing her complaint about hospital services on the Internet.
“We don’t expect innocent people, who don’t have a motive [for defamation], to fall victim [of the law],” Constitutional Court chief Moh. Mahfud MD told a press conference Wednesday.
Prita is currently being detained at the Tangerang Women’s Penitentiary after Omni International Hospital filed a lawsuit against her. She is accused of violating the law, which carries a maximum sentence of six years in prison.
The Constitutional Court recently turned down a judicial review filed against the law by the Alliance of Independent Journalists for fear the law would restrict press freedom and freedom of expression.
“The substance of the law is constitutional, we can not give leeway for people to insult others,” Mahfud said of the verdict.
The article stipulates that anyone found guilty of publishing defamatory or insulting information on the Internet could face six years' imprisonment and a penalty of Rp 1 billion (US$ 98,000.00). (adh)
