Ex-West Java governor gets 4 years in prison, fined Rp 200m

The Corruption Court handed down Tuesday four-year jail terms to former West Java governor Danny Setiawan and his two former subordinates, Wahyu Kurnia and Ijudin Budhayana, after finding them guilty of corruption.

"Danny Setiawan, Wahyu Kurnia and Ijudin Budhayana are legally and convincingly guilty of collective corruption," presiding judge Moefri said, reading the verdict.

The judges, including Moefri and Anwar, also ordered them to each pay Rp 200 million (US$19,557) in fines or serve an additional six months in prison.

"Danny as provincial secretary in 2003 and West Java governor in 2004, and Wahyu Kurnia, as appliances planning office head and Ijuddin Budhyana, as program monitoring office head, had directly appointed PT Istana Sarana Raya owned by Hengky Samuel Daud and PT Setia Jaya Mobilindo owned by Yusuf Setiawan to provide fire engines and ambulances to the provincial administration between 2003 and 2004," Moefri said.

The three defendants also decided to directly appoint PT Traktor Nusantara, PT Setia Utama Mobilindo and PT Satal Nusantara to partake in the Rp 140 billion project.

Danny issued a gubernatorial decree arranging what equipment would be purchased for the project based on proposals from the firms.

"The decree also stated the type and brand of the engines that accommodated the type and brands provided by those firms," judge Anwar said.

The defendants' crimes allowed the companies to mark up the fire trucks prices and earn massive profits from the project.

PT. Setia Jaya Mobilindo earned Rp 18.23 billion, PT Satal Nusantara Rp 6.44 billion, PT Setia Utama Mobilindo Rp 7.49 billion, PT Traktor Nusantara Rp 23.08 billion and PT Istana Sarana Raya Rp 16.79 billion.

"The companies' profits are illegal since their appointments did not follow the official procedures," Anwar said.

In total, the state suffered Rp 72.03 billion in losses.

"The three defendants also received Rp 2.5 billion *Danny*, Rp 1.6 billion *Wahyu* and Rp 380 million *Ijudin* as kickbacks from the suppliers," Anwar said.

Danny said he accepted the verdict while Wahyu and Ijudin decided to use their seven-day period given by the court to consider whether to file an appeal or not.

The Corruption Court has sent many government officials including former director general of regional autonomy, Oentarto Sindung Mawardi, also a suspect in the case, to jail for their involvement in similar cases in other provinces.

Former Medan mayor Abdillah and his vice mayor Ramli Lubis received five and four years respectively while former Makassar mayor Baso Amiruddin Maula and former Riau governor Saleh Djasit received four years each. They are all serving their jail sentences at the Cipinang Penitentiary in East Jakarta.

In a recent development, the Corruption Eradication Commission (KPK) halted the corruption trial of Yusuf Setiawan, who died of liver complications last month. The KPK has just started the legal process for Hengky on July 20 after a three-year hunt.
