Based on facts and the weakness of evidence — both formal and material — from investigators, for the sake of the credibility of the rule of law, and fair and impartial law enforcement, and to maintain a sense of justice, the legal proceedings against Chandra M. Hamzah and Bibit S. Rianto should be suspended.
In this case the [fact-finding team] recommends:
● The police issue a case suspension letter if the investigations are still in the hands of the police.
● The Attorney General’s Office issue a case suspension decree if the cases have been handed over to prosecutors.
● The attorney general suspends investigations for the sake of public interests.
After studying problems facing institutions and personnel of law enforcement agencies, in whi ch basic weaknesses have been found, the [fact-finding team] recommends the President:
● Maintain a sense of justice by handing down sanctions against officials responsible for the [contrived] legal processes and conduct institutional reforms within the National Police and the Attorney General’s Office.
● Continue with the institutional reforms and reshuffling of personnel at the National Police, the Attorney General’s Office, the Corruption Eradication Commission (KPK) and the Witnesses and Victims Protection Agency, while being careful to uphold the independence of state institutions, in particular the KPK.
● To reform the law-enforcement agencies, the President can order a “governance audit” to be conducted by an independent institution, to identify basic problems and weaknesses in the agencies.
After learning that law enforcement has been disrupted by case brokers who prevail in all law enforcement agencies, as “shock therapy” the President should prioritize a crackdown on case brokers in law enforcement institutions, including the judiciary and professional lawyers, beginning with a thorough investigation of the alleged court mafia case involving Anggodo Widjojo and Ari Muladi.
Investigations into other related cases — such as the Masaro graft case; the legal process against Susno Duadji and Lucas in connection with Budi Sampoerna fund at Century Bank; and the procurement of radio telecommunications equipment at the Ministry of Forestry — should be completed.
After studying criticisms and inputs concerning the weak strategy and implementation of law enforcement, and poor coordination among law-enforcement institutions the President is advised to set up a commission to draw up a clear and comprehensive program on the direction and steps to be taken in reforming law-enforcement institutions (including lawyer organizations), and to coordinate with other law-enforcement institutions in upholding the rule of law, the due process of law, human rights and justice.
