Businessman gets six years for helping Gayus Tambunan

T

he South Jakarta District Court sentenced Andi Kosasih (see photo) to six years in prison and Rp 4 billion (US$444,000) in fines for his involvement in the embezzlement case of Gayus H. Tambunan.

The head of the panel of judges, Prasetya Ibnu Asmara, said Monday Andi was found guilty of creating a fake agreement letter with Gayus. The letter said Andi gave Gayus US$2.8 million for Gayus to purchase property for him. The agreement letter was created in the hopes that it would prevent Gayus from being detained and to ensure Gayus’ bank account remained open. Gayus later admitted the money was his, not Andi’s.

Andi, a businessman from Batam, was also charged with giving false information to police investigators and bribing police detective M. Arafat Enanie with Rp 5 million.

Andi also received Rp 3.9 billion from Gayus for his “services”, the court said, as reported by tempointeraktif.com.

In their verdict, the judges said Andi was guilty of three of the charges: providing false information, bribery and profiting from criminal activity. Andi was found not guilty of obstructing a police investigation.

The verdict was less than the 10 years in prison requested by prosecutors.

Later on the same day, the court also sentenced Lambertus Palang Ama to three years in prison. Lambertus was Andi’s accomplice in the land-deal claim.

Presiding judge Sunardi also ordered Lambertus to pay a Rp 150 million fine or spend an extra month in prison.

Sunardi said that Lambertus was guilty of making a false statement before the court.

The sentence was lighter than the prosecutor’s demand of five years in jail.
