Driver indicted for murder in crash that killed nine people

priyani Susanti, the drunk driver who earlier this year crashed her car, allegedly leading to the wrongful deaths of nine pedestrians, was indicted for murder at the Central Jakarta District Court on Thursday.

If found guilty, the 29-year-old woman, who was also slapped with reckless driving and drug charges, will face a maximum of 15 years’ imprisonment.

The indictment read out by prosecutor Emilwa Ridwan said that the defendant had been clubbing the night before she allegedly lost control of her vehicle and hit 13 pedestrians, killing nine of them, on Jl. MI Ridwan Rais in Gambir, Central Jakarta, on Jan. 22.

Prosecutors said Apriyani was driving under the influence during the accident, as she had drunk alcohol and took ecstasy pills.

According to the indictment, Apriyani had been warned three times by her friend Ary Sendy Trisdiarto that she should not have been driving and that she should have taken a taxi go home. Ary, who was in the ill-fated Daihatsu Xenia, said that Afriyani “looked tired” after he partied with her until 3 a.m. at Stadium nightclub in Hayam Wuruk, West Jakarta.

But the defendant, who was dressed in Islamic attire while taking the stand, was said to have insisted she was not under the influence of drugs and was thus able to drive.

 “I am used to staying up late,” the indictment said, quoting Apriyani.

Apriyani is the second person in recent memory to be charged with murder in the case of a traffic accident.

She was preceded by a Metromini bus driver who caused the death of 33 people when his vehicle plunged into the polluted Sunter River in North Jakarta.

The man was convicted of murder and sentenced to 15 years in jail, despite his pleas that he was only a driver and never had the intention to kill.

While legal experts are divided over whether it was legally appropriate to slap Apriyani with murder charges, the families of the victims bemoaned the fact that the maximum punishment for Apriyani was only 15 years in jail.

“We want [the court] to impose the heaviest sentence on her. Remember that she has taken nine lives with her actions,” said Jumari, who lost his brother Muhammad Akbar, 22, in the accident.

The other victims are identified as Firmansyah, 17; Buhari, 17; Wawan Hermawan, 25; Muhammad Huzaifah, 16; Nur Alfih Fitriasih, 18; Yusuf Sigit Prasetyo, 2 and a half years old; Nani Riyanti, 25; and Suyatmi, 50.

Jumari said that the presiding judge must consider the fact that Apriyani had ignored her friend’s suggestion not to drive and was therefore aware that she was too drunk to drive. The trial was presided over by Antonius Widyatono.

Apriyani was tight-lipped as she went to and from court, refusing to answer journalists’ questions.

Her lawyer, Efrizal, said that prosecutors should not have charged his client with murder, claiming that the indictment was not based on the testimonies of the witnesses in the case dossier.
