he Jakarta Police are considering allowing musician Ahmad Dhani to take his youngest son, Ahmad Abdul '€œDul'€ Qodir Jaelani, 13, to Singapore for further medical treatment for injuries sustained in a recent deadly car crash.

'€œIf treatment in Singapore can get Dul better, faster, we will definitely give our permission because we will be able to examine him sooner,'€ Jakarta Police spokesman Sr. Comr. Rikwanto said on Friday.

Dhani said recently that taking Dul to Singapore was necessary because the medical team at Pondok Indah hospital in South Jakarta detected more bleeding in his lungs even after surgical treatment.

Dul was seriously injured after his car was involved in a crash on the Jagorawi toll road south of Jakarta early on Sunday. The crash left six dead and nine others injured.

Police have named him a suspect in the accident as he was behind the wheel of a Mitsubishi Lancer that slammed into oncoming traffic on the toll road hitting a Daihatsu Granmax, which in turn hit a Toyota Avanza.

Rikwanto said on Friday that Dul could be charged under the 2009 law on land transportation and traffic control, which carries a maximum sentence of six-years'€™ imprisonment.

However, as Dul is underage, the police will also refer to Law No. 23/2002 on child protection, so that if he is found guilty, his punishment could be reduced by 50 percent.

Questioned by the Jakarta Police as a witness in the case, Dhani admitted that he gave his three sons luxury cars, including the Lancer, and hired them drivers but did not know why Dul was driving by himself at the time of the accident.

According to Rikwanto, Dhani'€™s ex-wife, Maia Estianti, and Dul'€™s driver, Kirman, will also have to undergo questioning next week.

Meanwhile, Indonesian Commission on Child Protection (KPAI) member Muhammad Ikhsan said that Dul should not be jailed for his wrongdoing because it may affect his psychological condition.

'€œIf he is punished by imprisonment, he could be influenced by other criminals,'€ Ikhsan, who has been appointed by the police as an expert witness in the case said on Thursday at the Jakarta Police Traffic Directorate headquarters in Pancoran, South Jakarta.

'€œI suggest that Dul should be rehabilitated and the KPAI will help facilitate a counseling program for him,'€ he said.

He added that the police could refer to Law No. 11/2012 on the juvenile justice system to provide for an out-of-court settlement of Dul'€™s case and facilitate reconciliation with the victims.

'€œEven though the law is slated to come into effect in July 2014, two years after it was enacted, out-of-court settlement is legally accepted if all relevant parties including the police, the courts and the victims agree to it,'€ he said. (ian)
