he Judicial Commission (KY) investigationin to South Jakarta District Court judge Sarpin Rizaldi on Tuesday concluded that the judge had committed a breach of ethics in his controversial decision on the pretrial hearing of the (now) National Police deputy chairman Comr. Gen. Budi Gunawan in February.
The commission's ruling on Tuesday recommended the Supreme Court, which supervises all judges across the country, impose six months non-hearing status on Sarpin in the case.
"A plenary session today agreed to issue a recommendation about the sanction. Our investigation confirmed that he violated a number of judicial principals including mistakenly quoting expert testimony in his verdict," KY deputy chairman Imam Anshori said on Tuesday night.
Imam said that the KY also found against Sarpin for his decision to receive legal assistance from lawyer Hotma Sitompoel, an act that violated the judges' code of ethics. Sarpin used the lawyer's assistance to file a defamation report against the KY to the National Police after the commission made a public statement saying that his verdict was controversial.
The Corruption Eradication Commission (KPK), which handled Budi's bribery case, in February was forced to transfer the three-star police general's probe to the Attorney General's Office (AGO), which later handed the investigation to the National Police, after Sarpin in his ruling concluded that the KPK's investigation into Budi was illegitimate. The National Police later dropped the case against Budi.
Contacted separately, South Jakarta District Court spokesman I Made Sutrisna said that the court had yet to receive official information from the KY regarding its recommendation. (++++)
