The Jakarta Corruption Court is set to hold two indictment hearings on Wednesday against suspended North Sumatra Governor Gatot Pujo Nugroho and his wife, Evi Susanti, for two different bribery cases involving Medan State Administrative Court (PTUN) officials and former NasDem Party secretary-general Patrice Rio Capella.

Based on the court schedule, both Gatot and Evi will each separately face two indictment hearings conducted by Corruption Eradication Commission (KPK) prosecutors. They had both been named suspects in the two cases by the antigraft body.

The first case began with the alleged misappropriation of a Lower Regional Assistance Fund and Social Assistance Fund (Bansos) in 2012, 2013 and 2014, which allegedly involved a number of North Sumatra provincial administration officials.

The North Sumatra administration had filed a pretrial petition at the Medan Court against the corruption investigation currently being conducted by the Attorney General's Office (AGO). The corruption case was being handled by the North Sumatra Prosecutor'€™s Office (Kejati) before the AGO took over.

In the midst of the administration's pretrial hearing against the AGO, the KPK discovered a possible bribery incident involving one of prominent lawyer Otto Cornelis Kaligis'€™ employees, Moch Yagari Bhastara Guntur, aka Gerry, who reportedly paid off three PTUN Medan judges and also the court'€™s clerk.

Kaligis, a NasDem Party member, was sentenced to five and a half years in prison last week for his role in facilitating the bribes.

The court's clerk, Syamsir Yusfan, was found guilty and sentenced to three years in prison for taking a US$2,000 bribe.

Rio Capella


The second case, involving former NasDem Party secretary-general Patrice Rio Capella, began when Patrice promised Gatot that he would halt an investigation at the AGO after Rio's aide, Fransisca '€œSisca'€ Insani Rahesti accepted Rp 200 million in cash from Gatot's wife.

Patrice was a member of House Commission III that oversees legal affairs, which supervises the AGO. The AGO is led by Attorney General Muhammad Prasetyo who is also a former NasDem Party politician.

Patrice was sentenced to 18 months in prison on Monday for taking the bribe.

In the first case, Gatot and Evi were both charged under Article 6 (1), Article 5 (1) and Article 13 of Law No. 31/1999 in reference to Law No. 20/2001 on corruption eradication and articles 55 (1) and 64 (1) of the Criminal Code.

In the second case, the KPK has charged Gatot and Evi under articles 5 (1) and 13 of Law No. 31/1999 in reference to Law No. 20/2001 on corruption eradication. (ags)(+)
