heSouth Jakarta District Court has overturned a pre-trial motion filed by formerCorruption Eradication Commission (KPK) chief Antasari Azhar regarding whatAntasari considered as the police's one-sided decision to halt an investigationthat could influence his legal status.
According to Antasari, the investigation, which was to track the text message containing Antasari's threat to Nasrudin prior to the latter's murder, was pivotal to prove Antasari's innocence in a murder case that saw him sentenced to 18 years in prison.
'The motion is overruled because the investigation, contrary to Antasari's beliefs, is still underway,' presiding judge Didiek Setyo Handono said as quoted by kompas.com on Friday.
Judge Didiek said the court would rule in Antasari's favor if there was proof that the police had issued the warrant to cease the investigation.
National Police lawyer Adj. Sr. Comr. W Marbun confirmed the ongoing investigation but then admitted that investigators still encountered difficulties presenting the text message because the cell phone containing the text message was still in the custody of the prosecutor.
Commenting on this, Antasari's lawyer Boyamin Saiman said as quoted by antara.co.id he would do the police a favor by asking the prosecutors to lend him the cell phone containing the text message.
He said if the prosecutors refused to lend him the phone then most likely Antasari would file another pre-trial motion but this time against the Attorney General's Office (AGO). (dic)
