Jakarta loses, wins in legal battles over land reclamation projects

Of four lawsuits filed against the city administration over the revocation of permits for Jakarta Bay land reclamation projects, the court has ruled in favor of the plaintiff in one case but in favor of the city in another, while legal proceedings in the other two cases are ongoing.

Legal suits have been knocking on the Jakarta administration’s door ever since Governor Anies Baswedan decided to stop the development of 13 artificial islands in the Jakarta Bay last year. The city is in ongoing legal battles with four developers whose principle permits were revoked following the decision.

The developers of islets M, H, F and I each filed a lawsuit with the Jakarta Administrative Court (PTUN), demanding the city void the gubernatorial decree signed by Anies on Sept. 6, 2018.

Of the four, the PTUN recently rejected the lawsuit filed by PT. Manggala Krida Yudha, the developer of islet M, and ruled in favor of the Jakarta administration on Tuesday.

The ruling reveals different takes by the court on the reclamation lawsuits, as the court had ruled in favor of PT Harapan Indah, the subsidiary of publicly listed PT Intiland Development Tbk, developer of islet H, in July. In that ruling, the court had ordered the city to void Gubernatorial Decree No. 1409/2018 that had revoked the company’s permit and to proceed with extending its permit for the development of islet H.

The city administration has appealed the ruling.

PT. Manggala Krida Yudha had filed its lawsuit on Feb. 27, and the panel of judges, presided by Andi Muh. Ali Rahman with members Enrico Simanjuntak and Umar Dani, handled the case.
