he South Jakarta District Court on Mondayordered a five-day delay in the pretrial hearing of former director of state oil and gas operator Pertamina, Suroso Atmo Martoyo, whose earlier pretrial petition challenging the Corruption Eradication Commission'€™s (KPK) decision to name him a suspect in a graft case was rejected by the same court on April 14.

'€œThe hearing is adjourned until Friday,'€ judge Martin said.

The court was forced to delay the pretrial hearing because the KPK legal team failed to show up.

The South Jakarta District Court on April 14 ruled against Suroso'€™s pretrial petition, claiming the court had no authority to challenge a law enforcement institution'€™s decision to name someone a suspect in a criminal case.

Former lawyer for the Pertamina director, Jonas Sihalolo, said his client had decided to renew his fight after the Constitutional Court (MK) issued a ruling on April 28 authorizing courts across the country to proceed with challenges to suspects' statuses in criminal cases.

'€œThe MK ruling is our legal basis for the current fight,'€ Jonas said.

In addition to the graft case, Suroso has been accused of accepting bribes of US$190,000 from PT Soegih Interjaya (SI) director Willy Sebastian Liem to help Innospec Limited, a UK-based fuel additives manufacturer, win a $4 million contract to supply a fuel additive called tetraethyl lead (TEL) in 2004.

The KPK indicted Willy in the case at the Jakarta Corruption Court on May 18. The commission is currently working on Suroso'€™s dossiers for his upcoming trial.
