"The KPU's actions do not constitute a crime, but an administrative violation. Administrative violations are usually related to ethics," Nelson said in Jakarta on Friday, as reported by tribunnews.com.
He said the KPU could have avoided the violation by sending a request letter to the Constitutional Court to legalize the opening of the boxes.
Even if the KPU had obtained the court's permission, he added, representatives from the Elections Supervisory Committee (Panwaslu) should have been on hand to witness the procedure.
However, Nelson acknowledged that opening the ballot boxes before the current election dispute was resolved may have been justified, as the KPU needed evidence to support itself in case it faced a lawsuit.
The Prabowo Subianto-Hatta Rajasa presidential ticket previously filed a complaint about the KPU to Bawaslu because the instruction to open the ballot boxes was sent out before the Constitutional Court had resolved the presidential election dispute. (fss)
