Bali Nine duo lodge second PK on fear of execution

T

wo Australian drug smugglers on death row, Myuran Sukumaran and Andrew Chan, officially lodged their second case review with the Denpasar District Court on Friday.

The duo is hoping for a case review amid fears that their execution could take place at any time since President Joko '€œJokowi'€ Widodo had rejected their clemency pleas.

The Denpasar District Court is yet to decide whether the second review can be considered.

As Chan and Sukumaran were not permitted to leave Kerobokan prison for security reasons, a court clerk visited them in the prison to accept the review bid.

'€œWe have come ['€¦] to give proper public service,'€ Ketut Sulendra, the Denpasar Court clerk who attended the prison, said.

Sulendra refused to comment whether the review would be accepted or not. '€œIt will be studied by the court head. ['€¦] he will decide whether it will be sent [to the Supreme Court] or not,'€ he said.

Chan and Sukumaran'€™s lawyer, Todung Mulya Lubis, admitted that the review had been lodged in an attempt to save his clients from execution. '€œAlthough they have been proven guilty of violating the law, we believe they do not deserve the death penalty because it is against the right to life under the constitution,'€ Todung said.

Todung claimed that his clients had changed to become better people. '€œWith all their rehabilitation, with all the changes that have taken place, I think they deserve a second chance,'€ he said.

He was confident that the second review could be processed, based on the Constitutional Court'€™s decision. '€œWe have right to lodge a review. We hope the Denpasar District Court will process it,'€ Todung said.

According to an existing regulation issued by the Supreme Court, a convict can register a case review only once to establish legal certainty. The team submitted a case review in 2010, which was rejected.

Sukumaran, 33, and Chan, 31, were convicted for attempting to smuggle over 8 kilograms of heroin from Bali into Australia in 2005.

Both Sukumaran and Chan have written personal letters to Jokowi and the head of the Supreme Court, which are included with the case review document lodged with Denpasar District Court.

Sukumaran expressed his regret, saying at the time he had been too young and stupid, and not educated. '€œI have attempted to change by doing positive and beneficial things for people around me,'€ wrote Sukumaran in his letter.

'€œI want you to know that I have changed. I am now a good person because of my experience here,'€ he added.

Chan said in his letter that he was making no attempt to justify what he had done and was now spending his time teaching other people not to make the same mistakes he had made. He was also learning to be a priest and hoped to be given a second chance.

Both Sukumaran and Chan have set up several programs in Kerobokan prison, where they have been detained for almost 10 years, including art and computer workshops, cooking classes and tennis lessons.
