orth Jakarta District Court has rejected a pretrial motion filed by a resident of Pari Island of the Thousand Islands regency, identified as Sulaiman, 35, to clear him of his suspect status in an alleged land breach against a business enterprise, which plans to build a resort.
Judge Agung Purbantoro said on Tuesday the decision taken by the Thousand Islands Police to name him a suspect in the case had met the court’s qualification.
Sulaiman was named a suspect by the police earlier this month for allegedly breaking into a house, which was claimed by PT Bumi Pari Asri, a company which plans to build a resort on the island.
He was charged under Article 385 of the Criminal Code (KUHP) on trespass with a maximum sentence of four years imprisonment.
Sulaiman claimed he had managed the house since 2012 and that it belonged to a Bogor resident named Sudin who had bought it from a Pari Island resident identified as Matlebar.
"I started to help guard and manage the house in 2012. But, suddenly the company claimed ownership of the land in 2016," Sulaiman said.
Land disputes in the Thousand Islands have occurred frequently as most of the residents only hold girik (customary land appointments) certificates, Land and Building Tax (PBB) payment receipts and a document regarding the sale and purchase of land (AJB) as evidence of land ownership. (yon)
