Japanese may face 7 years in jail

Japanese may face 7 years in jail

rosecutors requested on Tuesday that the Bandung Corruption Court in West Java sentence PT Onamba Indonesia president director Shiokawa Toshio to seven years in prison and a Rp 200 million (US$20,800) fine for allegedly bribing former industrial relations court ad hoc judge Imas Dianasari and clerk Ike Wijayanto.

Asrul Alimina, a Corruption Eradication Commission (KPK) prosecutor, said that the defendant was also guilty of trying to bribe Arief Sujito, an Industrial Relations Court ad hoc judge at the Supreme Court.

The request is lighter than the maximum sentence stipulated in the Corruption Eradication Law, which carries a maximum penalty of 15 years imprisonment.

The prosecutor said the defendant and his employee Odih Juanda, a human resources manager, had jointly bribed Imas to rule in the company’s favor in a labor dispute between PT Onamba Indonesia and its former employees, as Imas had the authority to decide on the industrial affairs case.

Asrul said that Shiokawa, through Odih, gave Rp 352 million to Imas, including a Rp 4.3 million two-night stay at Hotel Mercure Convention Center in Ancol, North Jakarta.

Another Rp 10 million was reportedly given to Ike to arrange which judges would hear the case and another Rp 10 million to secure the proceedings, Asrul said during the trial, presided over by judge Sinung Hermawan.

“The defendant constantly received reports from Odih about Imas’ efforts on their behalf to win the lawsuit filed by workers against his company,” said Asrul.

PT Onamba Indonesia won the case at the district court but the former workers appealed the ruling to the Supreme Court. The KPK arrested Imas and Odih at La Ponyo restaurant in Bandung on June 30, last year, when the appeal was in process.

During the raid, KPK officers confiscated Rp 200 million in cash, which was reportedly to be handed over to ad hoc judge Arief Soedjito at the Supreme Court.

On Tuesday, prosecutors also objected to the defendant’s testimony, which stated that Shiokawa had no idea about the bribery case.

Asrul said Shiokawa had worked in the US for six years before working in Indonesia as PT Onamba Indonesia president director in 2009.

 “The defendant has the ability to speak English and knows the situation here. So, we object to his previous statement, which said that he knew nothing about the bribery,” he said.

Previously, Imas Dianasari was found guilty of accepting the bribes and was handed six years in prison by the Bandung Corruption Court, while Odih was sentenced to four years in prison. Both of them were also ruled to pay Rp Rp 200 million in fines.
