Permendikbudristek PPKSP formally launched as 25th episode of Merdeka Belajar

ducation, Culture, Research and Technology Minister Nadiem Anwar Makarim has officially launched Education, Culture, Research and Technology Ministerial Regulation No. 46/2023 concerning the Prevention and Handling of Violence in the Education Unit Environment (Permendikbudristek PPKSP) as the 25th episode of Merdeka Belajar.
Permendikbudristek PPKSP was passed as a legal umbrella for everyone involved in the education system, to prevent and respond to sexual violence and bullying as well as discrimination and intolerance. In addition, the regulation is also designed to assist education units in dealing with cases of online and psychological violence, among others, from the perspective of the victim.
"For this reason, in the last few years we have involved various parties to design a regulation that can prevent and deal with violence in education units which we will launch together today as Permendikbudristek No. 46/2023 concerning Prevention and Handling of Violence in Educational Unit Environments," said Nadiem at the launching of the 25th Episode of Merdeka Belajar at the Plaza Insan Berprestasi, in Jakarta on Tuesday.
"Permendikbudristek PPKSP protects students, educators and educational staff from violence that occurs during educational activities, both inside and outside of the education unit," added the minister.
Minister Nadiem explained that the Permendikbudristek PPKSP is an important part of fulfilling the government mandate to protect children. This regulation replaces the previous regulation, Permendikbud No. 82/2015 concerning Prevention and Management of Violence in Education Units.
In addition, Ministry of Education, Culture, Research, and Technology (MoECRT) PPKSP also eliminates the gray area by providing a clear definition to distinguish different forms of physical and psychological violence, bullying, sexual violence, discrimination and intolerance. Apart from regulating acts of violence, this Ministry of Education, Culture, Research, and Technology (MoECRT) also ensures that there are no policies that have the potential to cause violence in educational units.
"This new regulation also explicitly states that there should be no policies that have the potential to cause violence, whether in the form of decrees, circulars, official notes, appeals, instructions, guidelines and others," said Nadiem.
In addition to these matters, Permendikbudristek PPKSP also regulates prevention mechanisms carried out by education units, regional governments and the Education, Culture, Research and Technology Ministry, as well as pro-victim procedures for handling violence that focus on recovery.
Education units are also mandated to form teams to prevent and handle violence (TPPK) and the provincial, district and city governments are mandated to form task forces (Satgas).
“TPPK and task forces need to be formed within six to 12 months after this regulation is passed, so that violence in education units can be dealt with immediately. If there are reports of violence, these two working groups must deal with violence and ensure recovery for victims, while administrative sanctions are given to perpetrators by considering educative sanctions while still paying attention to students' rights to education," said Nadiem.
Based on data from the 2022 National Assessment survey, 34.51 percent of students had the potential to experience sexual violence, 26.9 percent had the potential to experience corporal punishment and 36.31 percent potentially experienced bullying.
This finding was corroborated by the results of the 2021 National Survey of Life Experiences of Children and Adolescents by the Women's Empowerment and Child Protection Ministry (SNPHAR, KPPPA), in which 20 percent of boys and 25.4 percent of girls aged 13 to 17 years said they had experienced one or more types of violence in the past 12 months.
Complaint data received by the Indonesian Child Protection Commission (KPAI) on special protection for children in 2022 also stated that 2,133 children were victims of sexual crimes, including physical and psychological violence, pornography and cybercrime.
