Prosecutors defend charges in Nasrudin murder case

P

rosecutors insisted their charges against defendants over the drive-by shooting of businessman Nasrudin Zulkarnaen were clear, complete and valid and called on the Tangerang District Court to proceed with the trial.

"Although the murder was planned in Jakarta, the Tangerang District Court is authorized to hear the case because the crime scene was in Tangerang," prosecutor Riyadi said during Wednesday's hearing.

Riyadi said that since the murder was planned in South Jakarta, the trial should be divided into two parts: the planning and execution.

The planning trial implicates suspended Corruption Eradication Commission chairman Antasari Azhar, who allegedly ordered the assassination, former South Jakarta Police chief Sr. Comr. Wiliardi Wizar and media magnate Sigid Haryo Wibisono. Wiliardi is accused of hiring the gunman. Sigid allegedly supplied the money for the assassination.

"The defendants have agreed to be examined by investigators without the presence of their lawyers," Riyadi said.

Riyadi's statement came in response to objections filed by the defendants' team of lawyers in the previous hearing. The defense lawyers, including Juan Felix Tampubolon, Minola Sebayang and Fadil Juwait, claimed the prosecutors charges were "invalid, obscure and incomplete" and asked the court to drop the case.

Wednesday's hearing was the third for five defendants: Daniel Daen, Henrikus Kia Walen, Heri Santosa, Fransiscus Tadin Keran and Eduardus Mbete Ndopo, aka Edo.

All are charged with the premeditated murder of Nasruddin, the former director of state-owned pharmaceutical company PT Putra Rajawali Banjaran. If found guilty, they face the death penalty.

Prosecutors allege that Daniel tailed Nasrudin from his house to the Modern Land Golf Course, where Nasrudin played a round just before he was murdered.

Daniel is alleged to have then called Henrikus, who followed Nasrudin's car in an minivan driven by Sei Lela. The other accused allegedly followed on motorcycles.

When the car slowed down outside a housing complex on Jl. Hartono Raya, the suspects allegedly overtook and blocked it.

Daniel, riding pillion on one of the motorbikes, is accused on pulling out a gun and shooting the victim from the left hand side of the car.

Nasrudin was in critical condition after the shooting. He died in hospital 22 hours later.

One of the alleged executors, Sei Lela, remains at large.

The panel of judges postponed the trial and will make a pretrial decision next Wednesday.
