FSPMI to file lawsuit against Gorontalo gov

FSPMI to file lawsuit against Gorontalo gov

he Gorontalo chapter of the Indonesian Metal Workers Federation (FSPMI) will file a lawsuit with the State Administrative Court (PTUN) in Manado, North Sulawesi, to reject a Gorontalo gubernatorial decree on the 2014 provincial minimum wage (UMP) issued by Governor Rusli Habibie.

The FSPMI deemed the gubernatorial decree that set the UMP at Rp 1,325,000 (US$108) lacked clear legal reference.

'€œThe UMP is lower than the Rp 1,425,000 proposed by the remuneration council, which is odd. We still have until January to file a lawsuit,'€ Gorontalo FSPMI deputy chairman Kusmayadi Somba said on Monday.

Kusmayadi, who is also a member of the remuneration council representing workers'€™ unions, said the gubernatorial decree was contrary to Law No. 13/2003 on manpower, which stipulates that the set UMP should take into consideration the recommendation given by the remuneration council.

The FSPMI claimed that Rusli was the first governor in Indonesia to set the UMP lower than recommended by the remuneration council.

Kusmayadi said the UMP increase was only 12.77 percent, a stark difference from the 40 percent increase that workers enjoyed in 2013.

Separately, Rusli said the 2014 UMP had been determined according to the procedures.

'€œThe FSPMI may file a lawsuit at the State Administrative Court. It'€™s their right,'€ Rusli said by phone.
