Corruption Eradication Commission (KPK) prosecutors demanded on Thursday that the Jakarta Corruption Court sentence a businessman to 12 years in prison for his role in the graft-ridden vehicle simulator procurement project at the National Police.

Prosecutors said Budi Susanto, who owns PT Citra Mandiri Metalindo Abadi (CMMA), was proven guilty of marking up the budget of the Rp 200 billion (US$16.4 million) project and enriching himself with money derived from the project amounting to Rp 88 billion.

'€œ[We] demanded that the panel of judges decide the defendant was guilty of joint corruption as stipulated under Article 2 of Law No. 31/1999,'€ prosecutor Riyono said while reading the demand at the Jakarta Corruption Court in Kuningan, South Jakarta.

The team of prosecutors also demanded the judges order Budi to pay Rp 500 million in fines or serve an additional six months in prison.

The court would also require Budi to pay back the Rp 88 billion in state losses that he caused, according to the KPK'€™s prosecutors.

If Budi failed to return the money within one month after he received his verdict, then his assets would be confiscated and auctioned in order to pay for state losses, said the prosecutors.

The team of prosecutors cited the incriminating factors against Budi '€” he did not support the country'€™s
efforts to combat corruption through his actions and he tarnished the image of the police as a law enforcer.

The KPK'€™s prosecutors also stated factors that could spare Budi from heavier punishment '€” he had never been convicted before and he had behaved politely throughout the trial process.

The court session was shortened as Budi claimed that he was suffering from diarrhea. '€œYour honor, for the sake of health concerns, isn'€™t it better for the demand reading to be postponed? Because he [Budi] has gone to the bathroom 16 times [already],'€ said one of Budi'€™s lawyers.

Presiding judge Amin Ismanto, however, declined the request, reasoning that the court session should still proceed as Budi'€™s detention period was due to expire soon.

Throughout the trial session, Budi went to the bathroom once.

According to prosecutor Iskandar Marwanto, Budi committed corruption with former National Police Traffic Corps (Korlantas) chief Insp. Gen. Djoko Susilo, former corps deputy chief Brig. Gen. Didik Purnomo, the procurement auction committee chairman Adj. Sr. Comr. Teddy Rusmawan and PT Inovasi Teknologi Indonesia director Sukotjo S. Bambang.

Besides being guilty of inflating the budget of the vehicle simulator procurement project, Budi, with the help of Teddy, was also guilty of tampering with the project'€™s tender process in order for his company to win the tender.

After winning the tender, Budi then decided to subcontract the project to PT Inovasi Teknologi Indonesia.

Besides Budi, the money from the project, which cost the state Rp 144 billion, also went into the hands of Djoko (Rp 37 billion), Sukotjo (Rp 3 billion) and Didik (Rp 50 million), according to Iskandar.

So far the KPK had named four suspects in the case. Only Djoko has been convicted.

Djoko was initially sentenced by the Jakarta Corruption Court to 10 years'€™ imprisonment, only for the the Jakarta High Court to increase the prison term to 18 years.

In its verdict, the Jakarta High Court also ordered Djoko to return Rp 32 billion to the state.
