he National Commission on Human Rights (Komnas HAM) has urged Citibank Indonesia CEO to issue a clarification regarding claims of unfair dismissal and discrimination from four former staff members.
'Komnas HAM is giving the CEO of Citibank Indonesia 14 days to clarify reports of alleged unfair dismissal and discrimination claims submitted to us by the four former Citibank workers,' Komnas HAM commissioner Siti Noor Laila said in a letter sent to Citibank and forwarded to media in Jakarta on Sunday.
The complainants' lawyer, Jhonry Gultom, said that according to the South Jakarta Manpower Agency, Citibank Indonesia's dismissal of its four senior managers did not follow proper dismissal procedures regulated by Law No.13/2003 on Manpower.
'We have issued a statement to the effect that it was improper for Citibank to dismiss them. We issued the recommendation following a tripartite meeting between Citibank's lawyer and the four senior managers dismissed,' wrote manpower agency head Dwi Untoro Pudji Hartono as quoted by Antara news agency.
Dwi said Citibank Indonesia had dismissed the four senior managers without giving them first, second or third warning letters. 'It is in contravention of the 2003 Manpower Law.'
Citibank Indonesia suspended and laid off the four senior managers on July 25, 2013.
Jhonry said Citibank Indonesia's management claimed that it had suspended the employees because they had absconded from company events selling credit cards and non-collateral loans. The marketing events in question were conducted at offices in Jakarta's Golden Triangle, the financial district bordered by Jl. Jend. Sudirman, Jl. MH Thamrin, Jl. HR Rasuna Said and Jl .Gatot Subroto.
Jhonry said it seemed likely that Citibank had dismissed the four employees for reporting alleged banking frauds by Citibank management, including forging of data of customers and Citibank's partner companies.
'More senior managers allegedly involved in the fraud were only sanctioned; however, the four employees who reported the fraud were suspended,' said Jhonry.
Head of group communication at Citibank Indonesia, Agung Laksamana, said: 'The banking business depends on trust. In this case, we have carried out the industrial relations dispute procedures in line with existing laws and regulations. The legal process is being handled by the industrial relations court in Central Jakarta. We respect the ongoing legal process.' (ebf)(+++)
