eeza Tracey Ormsby, 36, a New Zealand national arrested in February for drug possession, is likely to escape a heavy sentence as the Denpasar Police failed to obtain adequate evidence.
The police will only charge Ormsby with possession of a cigarette containing hashish, which she acknowledged was hers. Charges related to the 27.06 grams of hashish and 132.2 g of MDMA (Methylenedioxymethamphetamine) have not been included in the police dossier.
'The police only included possession of the hashish cigarette as evidence. They did not have enough evidence to include possession of other types of drugs,' explained prosecutor Ni Luh Oka Ariani after receiving the P21 dossier for Ormsby's case at the Denpasar Prosecutor's office on Tuesday morning.
The P21 dossier is the final documentation resulting from the examination process, which must be submitted to the Prosecutor's Office for the issuance of an indictment letter to bring the case to court.
Ormsby, who lives in Sydney, Australia, has been detained at Denpasar Police detention center for almost three months since she was caught in possession of drugs at Villa Askara in Dalung, North Kuta.
At that time, police seized a cigarette containing hashish from Ormsby's handbag, and found 27.06 g of hashish and 132.2 g of MDMA in the villa.
However, during the investigation, Ormsby continued to deny the drugs found in the villa belonged to her, admitting only to the hashish cigarette in her bag.
Ormsby stated that she had not rented the villa, although she had stayed there. The renter was an Australian musician, who already left the villa before the police raid. Ormsby had met the band member only one day before the raid.
Initially, the police were certain that Ormsby had stayed at the villa and knew about the drugs as she had the villa keys.
In the dossier, Ormsby is charged under multiple articles of Law No. 35/2009 on narcotics, which carry a maximum sentence of 12 years' imprisonment.
In addition to the cigarette, the police have also included the handbag and villa keys as evidence. After the dossier was handed over, Ormsby was taken to Kerobokan Penitentiary.
She will stay there during the trial, which will be scheduled later. 'The prosecutor has 20 days to process the dossier before handing it over to the Denpasar District Court. Once it has been handed over to the court, they will schedule the trial,' Ariani said.
The investigator refused to comment on the case. However, Denpasar Police drugs section head, Comr. Agus Tri Waluyo, earlier said the police were working hard to uncover information. 'The investigation still continues,' he said.
Ormbsy refused to comment, saying only: 'I have already told the truth [to the investigator].'
She also conveyed her hope to go home to several journalists.
Ormsby's lawyer, Ary Soenardi, said, 'Anything can happen [in court], we will just hope for the best.'
