orruption Eradication Commission (KPK) chairman Abraham Samad says decisions made by the anti-graft body will remain valid although it has less than five members in its leadership team.
'What I need to assert is that there is no article mentioning that if KPK leadership consists of only four people, then all of its decisions will become invalid,' he said as quoted by Antara news agency on the sidelines of the National Conference on Corruption Eradication in Jakarta on Tuesday.
Abraham was speaking in response to concerns about the commission's incomplete leadership, which triggered worries about it performing ineffectively.
On Wednesday, House of Representatives Commission III overseeing legal and security affairs is scheduled to carry out fit-and-proper tests on two candidates for the KPK leadership position: outgoing KPK commissioner Busyro Muqoddas and Cabinet Secretariat Office international relations division head Robby Arya Brata.
'No space allows us to deal with any lawsuits. If there is someone who intends to file a lawsuit against us, it's weird because he or she doesn't have any legal basis to do that. Just show me any article stipulating that the KPK's decisions must be made by all of its five leaders,' said Abraham.
He said decisions made by the commission's leadership were 'collective and collegial' in nature, not based on 'voting'.
'Again, the KPK leadership is collective and collegial in nature so that its decisions have never been made based on voting because law enforcement is not a political space that must be resolved through voting,' Abraham said.
He said there should be no concerns about a possible decline in work performance if the number of KPK leaders was less than five people as required by Law No. 30/2002 on the KPK.
'Let alone four leaders, even if there are only two leaders, the KPK still can work normally. So actually, there is no problem with us,' said Abraham.
He added there was also no need for the government to issue a presidential regulation or any other regulation to appoint a replacement for Busyro, whose terms ends in December.
'We are ready to cooperate with any leader that is selected. We are not in a position to agree with or to reject a candidate. Our position is neutral. We will accept anyone selected and hope we can work together,' said Abraham. (ebf)(+++)
