he South Jakarta District Court has accepted the request of National Police chief candidate Comr. Gen. Budi Gunawan to declare the Corruption Eradication Commission's (KPK) move to declare him a graft suspect as invalid, paving the way for President Joko 'Jokowi' Widodo to swear in Budi as the new police chief.
Judge Sapin Rizaldi, who presided over a pretrial session at court on Monday, decided that the court would accept Budi's request that the KPK's naming of him as a suspect in connection with alleged graft between 2004 and 2006 be rejected.
The court also rejected Budi's request to be paid back losses amounting to Rp 1 million from the legal proceedings, as such losses could not be proven.
'The court accepts the petitioner's request to turn down the KPK's move to name him a suspect and rejects his claim to have suffered Rp 1 million losses from the case, because it cannot be proven during the pretrial hearing,' he said.
Budi, who has won political support from the House of Representatives to lead the National Police, filed a pretrial petition with the South Jakarta District Court after he was named a suspect on Jan. 13.
He was named a suspect based on the allegation that he accepted a huge amount of money when he was chief of the National Police's Career Development Bureau from 2004 to 2006.
Despite the House's political support, the President suspended Budi's inauguration to await the outcome of the pretrial hearing.
Given the result of that hearing today, the President is expected to swear in Budi as the new police chief soon to end the mounting conflict between the police and the KPK
