lawyer representing the Corruption Eradication Commission (KPK) has slammed a judge'€™s decision to accept police chief hopeful Comr. Gen. Budi Gunawan'€™s pretrial petition, saying it sets a bad precedent in the ongoing battle against corruption in the country.

'€œAfter this pretrial decision, it'€™s certain that all criminal suspects in the police, Attorney General'€™s Office or KPK, will file pretrial petitions,'€ Chatarina Mulia Girsang, a member of the KPK'€™s legal team, said here on Monday.

She said the KPK was prepared to face all pretrial petitions filed by those it had named as graft suspects in the future.

According to Chatarina, the KPK had prepared for win and lose scenarios in Budi'€™s pretrial, but added that it was regrettable that the judge had made a decision that, according to her, went beyond legal procedure.

'€œThe judge was inconsistent because he followed a legal proceeding that went off track,'€ she said as quoted by kompas.com

She said that in his considerations, the judge stated that the KPK'€™s move to name Budi a graft suspect was part of the investigation carried by the commission, and that Budi was not a law enforcer nor a public official when he was chief of the police'€™s Career Development Bureau from 2004 to 2006, thus, the commission had no authority to investigate Budi.

The judge also said the Budi case had not caused public unrest nor any material loss to the state. (rms)(++++)
