ormer Supreme Audit Agency (BPK) chairman Hadi Poernomo has failed to answer the latest Corruption Eradication Commission (KPK) summons for questioning in relation to a high-profile tax write-off case involving Bank Central Asia (BCA).
Last week Hadi also failed to show up for KPK questioning about his role in the case, which occurred while he was serving as the Finance Ministry's director general of taxation between 2002 and 2004.
Hadi was accused of preferential treatment by approving a request from BCA for a tax write off.
Hadi's lawyer Yanuar Wasesa said his client was suffering from a heart problem and had to be rushed to a hospital on Wednesday night.
'We have shown a letter from his doctor to the KPK so that they can postpone the questioning. Pak Hadi is currently receiving treatment at Pondok Indah Hospital in South Jakarta,' Yanuar told The Jakarta Post on Thursday.
When asked if Hadi would answer the KPK's next summons, Yanuar said that it depended on Hadi's health condition.
The case began when BCA issued a request to the income tax directorate on July 12, 2003 for a tax write off as a result of bad-loan restructuring worth Rp 5.7 trillion in 1999.
After evaluating the request the directorate announced on March 13, 2004, that it had turned down the request, but one day before the deadline for the bank to pay the taxes, Hadi, in his capacity as the tax boss, annulled the decision and granted BCA's request.
