he South Jakarta District Court has turned down the pretrial petition filed by graft suspect Sutan Batoegana, paving the way for the Corruption Eradication Commission (KPK) to bring his case to court.
'(The court) decided to turn down the pretrial petition filed by former chairman of House Commission VII on energy and environment Sutan Batoegana,' judge Asiadi Sembiring said in a hearing at the court in South Jakarta on Monday.
Referring to Chapter 82 of the Criminal Code (KUHP), Asiadi said that a pretrial petition could no longer be processed and declared default after already being taken up by the district court.
The court's decision was consistent with the KPK's argument that that the petition should be dismissed because the case was already underway at the district court.
Responding to the verdict, lawyers accompanying Sutan in the pretrial petition said their client was disappointed.
'We will file a request with the Supreme Court to review the court's verdict because the judge has no courage to process the petition, said Eggi Sudjana, a member of Sutan's lawyer team,
According to Eggi, the judge was inconsistent, unfair and unqualified. (rms)(++++)
