Unless otherwise agreed, The Jakarta Post Advertising Terms and Conditions (“Terms and Conditions”) apply to all matters concerning The Jakarta Post advertisement particularly in 2019. This Terms and Conditions serve as legal document and binding provision for the use of all advertisement products (“products”) from The Jakarta Post Business Team (“The Jakarta Post”). By agreeing to cooperate and signing the Booking Order, Client also expresses its agreement to be bound by this Terms and Conditions.
The products mean all advertisements placed and appear in print and electronic or digital format, owned and represented by The Jakarta Post including, but not limited to, newspapers, digital editions, websites, online services, mobile sites, and other media outlets as stipulated within this Terms and Conditions. This Terms and Conditions does not concern or include advertisements placed by The Jakarta Post’s internal divisions, and all advertisements placed outside the general media placement. With regard to programmatic buying, this Terms and Conditions will apply to the extent as the market practices do not require otherwise and will be further regulated in separated Agreement regarding programmatic buying.
This Terms and Conditions apply when Advertisers agree to place advertisements in any forms such as Regular Ads, Classified Ads, Online Display Banner Ads, Online Sponsored Content, and Online Sponsored and Other Ads. If the advertisement is submitted by an agent, the agent is responsible for ensuring compliance with all aspects of the agreed Terms and Conditions in the same manner as they are responsible for fulfilling their own obligations (including responsibility for the content of the Material and for the advertisement fee with full liability for any credit losses).
This Terms and Conditions may change at any time and this does not apply retroactively to the agreement that occurred before this document was agreed by the Parties. If the Client currently has an Agreement with The Jakarta Post regarding the matters stipulated within this Terms and Conditions, the provisions contained in the Agreement shall supersede any conflicting provisions in these Terms and Conditions.

When you contact our Advertising Department, our representative would handle your request. Our people will take your ad information and would give you a Booking Order document for you to sign. Service will be process if you have signed your Booking Order document. Make sure that the advertisement written in the Booking Order document is correct.
An advertisement order must be prepared by the advertiser/agency. The order shall include the following:
No endorsement, statement, or disclaimer on the advertisement order or any separate document shall act as a waiver of any provision of the Terms and Conditions or other The Jakarta Post’s advertisement policies, unless agreed and signed by legally authorized representative of The Jakarta Post.
The Regular Advertisement is the advertisement placed in the Newspaper, outside the Classified page. The Regular Advertisement consists of:

Classified Advertisement is the advertisement placed in the Classified Page of the Newspaper. Classified Advertisement consists of:

Display Banner Advertisement is placed on certain pages of our website, where The Jakarta Post reserves the rights to determine which page is available for Advertiser. The specification, rates and the derivative types of each Sponsored Content Advertisement are contained within the Rate Card, which is also attached to The Jakarta Post Media Kit. The price stipulated within the Rate Card excludes 10% VAT.
The cost applied in the Rate Card for Sponsored Content Advertisement is based on the content production. The Jakarta Post provides services to help the Advertiser in creating the Ad content and publish the Ad on the website. Advertiser reserves the right to make revisions of maximum 1 major revision and 2 minor revisions without changing the main concept, topic, or the writing perspective.
We also provide standard landing page to Advertiser’s website on the Sponsored Content Advertisement. The Jakarta Post could also provide you with guaranteed views that can be customized with additional surcharge based on the amount of additional views.
Sponsored and Other Advertisement is placed in The Jakarta Post’s website www.thejakartapost.com. The Sponsored Content Advertisement consists of:
The specification, rates and the derivative types of each Sponsored and Other Advertisement are contained within the Rate Card, which is also attached to The Jakarta Post Media Kit. The price stipulated within the Rate Card excludes 10% VAT.
The cost stipulated in the rate card for Sponsored and Other Advertisement particularly that includes content making is based on the content production. The Jakarta Post provides services to help the Advertiser in creating Ad content in which the Advertiser reserves the right to make revisions of maximum 1 major revision and 2 minor revisions without changing the main concept, topic, or writing perspective.
For video production, the cost will depend on Advertiser’s brief and request. The Jakarta Post will create a separate document consists of production schedule and specification of the cost.

The ad could be place in any page except Editorial page (page 6, or whichever page Editorial is printed)
The ad placed in junior page (page 12, 13, and 20) could not exceed the half-page markers, except for page 1, which could not exceed 150mm height.

Advertorial is a term used to describe all content containing advertisements that is written by the Business Department of The Jakarta Post, based on requests from clients. Therefore, advertorial is not the product of The Jakarta Post Editorial Team.
The Jakarta Post reserves the right whether the advertorial could be published or not. The decision shall be based on the Advertorial Terms and Conditions as well as the Advertorial Acceptability, and the applicable law for advertisement in the Republic of Indonesia.
For advertorial, The Jakarta Post provides 3 (three) choices which are:
Advertorial images must come from in-house production (The Jakarta Post Photo Desk) or from advertiser. Images must not be taken from image-bank or wires agency.
Media Partnership means a form of cooperation between The Jakarta Post and its client both paid and unpaid, in print or in online platform. Unpaid Media Partnership shall be carried out with client whose vision, mission, and values of the company do not conflict with The Jakarta Post’s.
The content of the partnership will come from the decision between The Jakarta Post Marketing Department and Editorial before signing partnership agreement. The content of any article generated from the partnership is produced by Editorial Department without any interference from client due to Editorial independency.
Native Ad is a report or a special report that is paid by Sponsors – at least 1 page or more – where Client’s products are displayed and described in a new ‘brand journalism’ style. Native ad is solely produced by The Jakarta Post.
Inforial is a term used to describe article containing advertisement, written by The Jakarta Post Business Department. The content of the article is made by The Jakarta Post without interference of the advertiser. The Jakarta Post would be the host of the article without the involvement of our journalist.
Inforial articles must be labeled with “inforial” and/or breadcrumb indicating the nature of the advertisement. The label shall be placed above the article and the byline. If there is any video supporting the article, it must also be labeled with “inforial” and/or breadcrumb. The video shall be categorized into certain type of duration (30 seconds, 60 seconds, and 180 seconds). If there is any image supporting the article, it must use the in-house production of The Jakarta Post Photo Desk, and it is strictly forbidden to use images from any commercial bank-image or wires.
Inforial amplification through The Jakarta Post’s social media channels must also use inforial label as regulated by related social media platform.
Sponsored headline is term used for article containing advertisement features, written by The Jakarta Post Business Department. However, the content of the article could be made in consultation with the advertiser. The placement of Sponsor Headline is the same as online headlines and will appear in the main headlines before going down to the Index section. However, all Sponsored Headlines are limited by publication time that has been agreed upon the agreement between The Jakarta Post and advertiser.
Sponsored Headline could be in the form of single article or video without article. For a single video without article, it would be appeared on the Multimedia channel for the period of time that has been agreed upon the agreement between The Jakarta Post and advertiser.
Sponsored Headlined must be labeled with “Sponsored” and/or breadcrumb indicating the nature of the advertisement. The label shall be placed above the article and the byline. If there is any video supporting the article, it must also be labeled with “Sponsored” and/or breadcrumb. The video shall be categorized into certain type of duration (30 seconds, 60 seconds, and 180 seconds). If there is any image supporting the article, it must use the in-house production of The Jakarta Post Photo Desk, and it is strictly forbidden to use images from any commercial bank-image or wires.
The amplification of Sponsored Headline through The Jakarta Post’s social media channels must also use “Sponsored” label as regulated by related social media platform.
Deep Dive (Paid Longform Article) or Native Ad in Long Feature Form or Paid Interactive Page is a product of The Jakarta Post where advertiser’s product are displayed and described in written in a new ‘brand journalism’ style.
The article could be in a length between 500 – 1.200 words discussing one central issue in a deep and sharp perspective. Regular Deep Dive Article is usually supported by various multimedia elements such as images, info graphics, audio clip, or videos with an average of 3-7 minutes duration, including mini documentaries, interviews, etc. Deep Dive is quite different compared to other ordinary articles appearing on thejakartapost.com.
The product is divided into two categories:
The Jakarta Post reserves the right to disclose the Sponsor of each article. The name of the Sponsor will be placed above each article. All articles could have their own gateway on the thejakartapost.com homepage in the form of banner belt to indicate it’s advertorial nature.
Videos produced for these products might not be labeled with ‘paid’ mark since they are embedded within the articles. However, these videos could not be placed in other page on thejakartapost.com.
The amplification of Deep Dive or Native Ad in Long Feature Form or Paid Interactive Page through The Jakarta Post’s social media channels must also use “Brought to You By” or “From Our Partner” label as regulated by related social media platform.
Advertisement shall be paid for prior to publication deadline, unless Advertiser and/or the agency and The Jakarta Post agree that the payment could be made after the publication date. However, some of the advertisement categories would require prepayment such as the advertisement that contains multimedia production. Acceptable forms of payment are bank transfer. Credit card or advertiser/agency guaranteed check.
The Jakarta Post will issue an invoice after the Advertiser and/or Agency sign the Booking Order. Payment is due 14 (fourteen) days after the invoice date. The advertiser and agency shall be jointly and severally liable to The Jakarta Post for the payment.
The Jakarta Post could postpone or cancel the ad publication in case the Booking Order or the permission of payment after publication date has not been signed by the Advertiser and/or agency.
All advertisements accepted by The Jakarta Post is subject to all terms and conditions stipulated herein. The Jakarta Post will consider the acceptance of the advertiser regarding all rates and conditions that applicable by processing the Order. Processing the Order will also indicate acceptance of the Advertising Terms and Conditions also Advertorial Acceptability provided by The Jakarta Post.
This Terms and Conditions and all documents related with The Jakarta Post Advertisement are incorporated as contract and/or legal document between The Jakarta Post and advertiser and/or agency.
The Jakarta Post reserves the right to revise and/or create new Rate Cards and would be effective within 5 (five) working days after the distribution of the new Rate Card and/or prior notification to the advertisers and/or agency.
Advertiser and/or agency are welcome to request separate contract if needed. Our staff at Advertising Department will provide the advertiser and/or agency with the contract. It is also possible if the advertiser and/or agency would like to propose a contract from the advertiser or agency.
Contract request must specify the beginning date, type of advertisement, and must subject to the applicable Rate Card when the contract begins and shall accommodate in the event of modification of the Rate Card.
There is no minimum limit on the number of advertisement for contract. Advertiser and/or agency can only place 1 insertion or multiple insertions from the same ad or different ads.
For additional information on electronic ad submission including the transmission options and file settings, advertiser and/or agency shall comply the provision as follows:
In the event of material error provided by the advertiser and/or agency, The Jakarta Post would not take any responsibility.
The Jakarta Post reserves the right to postpone the placement of ad if the material quality does not meet The Jakarta Post’s standard.

The Advertising Department will examine advertisements before publication to determine if they meet the standards of acceptability The Jakarta Post developed.
The Jakarta Post reserves the right not to accept advertisement that is misleading, inaccurate or fraudulent, or which fails to comply within the standards of decency and dignity.
If an advertisement contains statement or illustrations that are not deemed acceptable, The Jakarta Post would notify the advertiser to change the advertisement. However, if changes cannot be negotiated, the advertisement shall be deemed cancel.
An advertisement shall be amended because of the applicability of the law in such matters as copy right, trademark, privacy policy, etc.
The Jakarta Post maintains clear separation between editorial and its advertisements. Ads that include elements that are related to The Jakarta Post editorial matter would not be accepted.
The Jakarta Post reserves the right to label an advertisement with the words “advertisement” (or any words related to advertisement), in order to create clear distinction between editorial and advertisement.

Cancelation of advertisement booking could only be accepted in writing.
The Jakarta Post reserves the right to require 7 days written notification of cancelation prior to the publication day or 1 day written notification of cancelation for display.
Cancelation in accordance with the terms written within this Terms and Conditions will be subject up to 75% of the rates based on the cost incurred and/or services that have been carried out by The Jakarta Post.
The exact amount of the cancelation fee would be mentioned within the Booking Order.
Cancelation not in accordance with the terms stipulated in Terms and Conditions would be subject to payment of full cost, due on date of cancelation.

All matters related to advertisement are governed by Indonesian law.
The parties hereby declare that if there is dispute arise related to the rights and obligations of the Parties based on the Terms and Conditions and all documents related to advertisement would be resolved through negotiation. If within 30 days the Parties could not reach consensus, the Parties agree to resolve the dispute by taking legal action at the Central Jakarta District Court.
