He said his administration used Presidential Regulation No. 40/2014, which is a revision of Presidential Regulation No. 71/2012 on the Implementation of Land Procurement for the Public Interest Development.
Meanwhile, the BPK referred to Law No. 2/2012 on the Implementation of Land Procurement for the Public Interest Development when the agency audited the land procurement, Ahok added.
The BPK considered that the land procurement carried out by the city administration violated existing procedures because based on the law, before procuring land, the government institution has to set up a dissemination team and the prices of land should be based on the taxable value of property (NJOP), the governor said.
According to Presidential Regulation No 70/2012, a government institution wanting to procure land less than one hectare does not need to follow all the procedures, like setting up a dissemination team. In Presidential Regulation No 40/2014, the threshold was changed to five hectares.
“That's what I protested. We procured the land based on the Presidential Regulation, while the BPK insists that it referred to the law. The BPK feels we violated the procedure because we should have set up a team and purchased with NJOP-based prices,” he added.
Ahok was questioned by Corruption Eradication Commission (KPK) on Tuesday based on the report of the BPK’s audit in 2014 and the BPK's investigative audit in 2015 that showed potential losses of Rp 199 billion (US$15.21 million) in the Sumber Waras land procurement.
Ahok said the BPK’s report was erroneous. (bbn)
