Referring to the letter from Ross Robertson published in The Jakarta Post on Feb. 23, herewith we submit the following explanation.
First, we appreciate your fiscal tax payment of Rp 2,500,000 when you left the country on Feb. 5, 2009. This was a legal obligation and according to the law.
Second, Article 8 of the income tax law, Law 36/2008 states that the taxation system on the basis of this law looks at the family as an economic totality and the taxation liability should be fullfilled by the head of the family. Article 1 no. 3 and 4, PER-51/PJ/2009 and II, SE-83/PJ/2008 a and b state that the head of the family, the husband, is responsible for the family members who become his, dependent on blood and marriage in a straight line descent.
Third, according to attachment II letter A of PER-53/PJ/2008, the name stated on the NPWP (tax card) must be the head of the family (the husband), and family members who go abroad have to attach the family card (kartu keluarga) and other related documents.
