Attorney general must boost law enforcement performance, says expert

ew Attorney General HM Prasetyo must improve the country'€™s law enforcement, which is suffering an organizational weakness in its institutions, including the Attorney General'€™s Office (AGO), an expert has said.

'€œIt is difficult for the public, including businesspeople, to feel the presence of legal certainty and justice,'€ former Corruption Eradication Commission (KPK) acting head Mas Achmad Santosa said in a release made available to The Jakarta Post on Sunday.

He added that law was often used to criminalize the innocent or protect those found guilty.

The former member of the Anti-Judicial Mafia Task Force went on to say that Indonesians'€™ perception of law enforcement in the country was really negative.

Citing the results of the 2012 World Justice Project survey, he said Indonesia'€™s rule of law index stood between 0.4 and 0.5 with 1 as the highest score.

'€œOne of root causes of this condition is widespread corruption in law enforcement institutions, including the AGO,'€ said Mas Achmad.

According to 2013 Global Barometer Survey, judiciary institutions (or institutions that carry out preliminary examination, investigation, prosecution and verdict ruling functions) in Indonesia were perceived to be some of the worst institutions in the country, with a score of 4.1, where one is very clean and five is the most corrupt.

Mas Achmad pointed out that corruption practices occurred in Indonesia in general and the performance of its law enforcement institutions meant the country was behind other countries in this area.

Indonesia'€™s competitiveness was one of the lowest among ASEAN member countries, as reported by KPMG'€™s Corruption Impact on the Business Environment 2013 report, he added.

'€œThis is because of the weakness of law enforcement institutions, including the AGO,'€ Mas Achmad said.

The weakness of prosecutor'€™s offices was caused by poor leadership, weak human resource management systems, weak case handling and weak monitoring.

'€œThe government, especially Attorney General Prasetyo and other leading AGO officials, have to strengthen prosecuting organizations in these four aspects,'€ said Mas Achmad. (ebf)(+++)
