Two groups have submitted requests with the Constitutional Court for a judicial review of the recently passed Tax Amnesty Law.
The first group respresented the Indonesian People's Struggle Union and two individuals, while the second petition had been submitted by the One Justice Foundation and another two individuals, said legal aid institute LBH Keadilan Jakarta Raya executive director Sugeng Teguh Santoso, whose office acts on behalf of the first group.
The second group is represented by the Heri Perdana Tarigan law firm in Central Jakarta.
"We submitted the judicial review petition on Law No. 11/2016 concerning the tax amnesty because it is against the Constitution," Sugeng, who is also the chairman of the One Justice Foundation, said after filing the request on Wednesday.
He added that his clients had asked the court to annul the law and were challenging 11 articles that included stipulations on the subjects and objects of the tax amnesty, on the penalty rates and on the obligations of the authorities to keep tax amnesty applicants' data confidential.
The groups presented as many as 21 reasons to back their petition, included allegations that the law would cause state revenues losses, hamper whistle-blower efforts, repeat mistakes of 1964 and 1986 tax amnesties and would be used for money laundering and tax evasion.
