Rangkap jabatan wakil menteri ancam kinerja pemerintah

Kurangnya mekanisme pengawasan terhadap wakil menteri yang berkinerja buruk meningkatkan risiko konflik kepentingan bagi anggota kabinet yang merangkap jabatan sebagai komisaris badan usaha milik negara (BUMN). Para ahli memperingatkan bahwa rangkap jabatan dapat melemahkan kinerja pemerintah secara keseluruhan.

Penunjukan puluhan wakil menteri sebagai komisaris badan usaha milik negara (BUMN) telah memunculkan kembali pertanyaan terkait konflik kepentingan dan potensi dampak rangkap jabatan ini terhadap kinerja pemerintah secara keseluruhan. Pertanyaan tersebut mengemuka di tengah tidak adanya mekanisme untuk mengevaluasi anggota kabinet yang berkinerja buruk.

Setidaknya 30 dari 55 wakil menteri dalam Kabinet Merah Putih kini juga menjabat sebagai komisaris di beberapa BUMN terbesar di Indonesia, serta anak perusahaannya. Kabinet pembantu Presiden Prabowo Subianto saat ini jumlahnya membengkak, hingga merupakan kabinet terbesar sejak era Reformasi dengan anggota lebih dari 100 orang.

Pengaturan rangkap jabatan semacam itu dapat menciptakan peran yang tumpang tindih dan membuka pintu bagi potensi konflik kepentingan. Hal itu dikemukakan pakar hukum tata negara Yance Arizona dari Universitas Gadjah Mada (UGM).

“Wakil menteri seharusnya melayani publik dan memastikan implementasi regulasi. Di sisi lain, komisaris fokus mengamankan keuntungan bagi BUMN,” kata Yance. “Mencampuradukkan tugas regulasi dengan kepentingan mencari keuntungan akan dengan mudah menciptakan konflik kepentingan.”

Yance melanjutkan bahwa konflik kepentingan juga dapat muncul ketika para wakil menteri tersebut menjabat sebagai komisaris di perusahaan yang beroperasi di sektor yang tumpang tindih dengan tugas mereka di kabinet. Hal itu berisiko mengubah regulator menjadi operator, yang akan “merusak tata kelola pemerintahan yang adil”.
