View all search resultsouth Jakarta District Court rejected on Tuesday a pretrial motion filed by social media persona Jonru Ginting, who is suspected of spreading hate speech.
“South Jakarta District Court adjudicates to reject the whole motion with no court fee,” single judge Wati Mulasimadhi said as quoted by kompas.com.
She added that based on evidence and police information, no preconditions for a pretrial motion were met as Jonru had not experienced any procedural errors or human rights violations.
Jonru had been named a suspect and since Sept. 30 detained at the Jakarta Police detention center. He was reported by a man named Muannas Al Aidid who considered Jonru’s social media posts to have incited hatred relating to ethnic, religious, racial or societal groups (SARA).
He was charged under the Information and Electronics Transaction (ITE) Law with a maximum punishment of 6 years’ imprisonment.
The Jakarta Police also charged Jonru under the Law on the Elimination of Racial and Ethnic Discrimination, which stipulates a maximum punishment of five years in prison, and article 156 of the Criminal Code on spreading hate toward certain groups, which carries a maximum punishment of five years imprisonment.
