Ministry expels 94 foreign workers from industrial zone over compliance issues

The Manpower Ministry has expelled 94 foreign workers from the special economic zone (SEZ) in Sei Mangkei, North Sumatra, for failing to meet legal requirements.

he Manpower Ministry has expelled 94 foreign workers from the special economic zone (SEZ) in Sei Mangkei, North Sumatra, for failing to meet legal requirements.

The ministry’s acting director general of supervision and occupational safety and health (K3), Ismail Pakaya, said the expulsion on Oct. 22 was carried out because the workers had yet to obtain the foreign workers use plan (RPTKA) approval. 

The RPTKA is a document that outlines why a company needs to hire a foreign worker, including information on specific positions to be filled, the qualifications needed and plans for training of local workers or transfer of knowledge.

Once the RPTKA is issued, a company can apply for the permit to utilize foreign workers (IMTK), which forms the basis for the working visa and stay permit.

Ismail explained that failing to comply with the requirement constituted a violation of Government Regulation (PP) No. 34/2021 and Manpower Ministry Regulation No. 8/2021 on the foreign workers utilization plan. 

The Manpower Ministry urged all companies employing foreign workers to comply with the regulations and mechanisms set up by the government.
