Hanura Party chairman sues Bawaslu over ineligibility to run in 2019

Oesman Sapta Odang is not on the list because he did not resign from his party as required by a Constitutional Court ruling.

anura Party chairman Oesman Sapta Odang has filed a lawsuit against the Elections Supervisory Agency (Bawaslu) after the General Elections Commission (KPU) deemed him ineligible run for a seat on the Regional Representatives Council (DPD). 

"Bawaslu said it has received notice of my suit and will discuss it," he said in Jakarta on Thursday as quoted by Antara. 

Oesman said the KPU had violated his constitutional right by excluding him and another Hanura Party member, Victor Juventus G. May, from the candidate list for the DPD in next year's election.   

He said he had also filed a petition for a judicial review with the Constitutional Court regarding its recent ruling in July that requires political party members running for DPD seats to resign from their parties. 

He insisted that the ruling applied only to the 2024 election. 

However, in a statement released on Thursday, the Constitutional Court said the ruling became effective as soon as it was issued. This means that party members who have not resigned from their parties are not entitled to run in the 2019 election. 

KPU commissioner Ilham Saputra said the omission of the two from the list was based on the Constitutional Court ruling. 

"The KPU waited for them to show their resignation letters [from the party] but never received any until Wednesday night before we decided on the final list," he said. (ris)
