The Supreme Court has ruled in favor of a teenage rape victim in Jambi, who had been accused of an illegal abortion, rejecting the cassation filed by the Muarabulian Prosecutor’s Office.
Damar Idiyanto, the lawyer representing the girl, said he had heard of “the good news” but had not received any copy of the court’s decision yet.
“This means [the girl] has been cleared of all charges,” he told The Jakarta Post on Monday. “This decision is final,” he said.
The decision also meant that the girl’s 35-year-old mother would be freed of the accusation that she was involved in the abortion, he added.
Batanghari District Court head Derman P. Nababan said the Muarabulian District Court had yet to receive any court excerpts or a copy of the decision in the case, as had the general crimes section head of the Batanghari Prosecutor’s Office, Heru Dwi Atmojo.
“This is a good precedent for upholding the rights of rape victims,” Save Our Sisters (SOS) spokeswoman Zubaidah told the Post. Zubaidah added that justices should consider the psychological condition of rape victims that led some to terminate pregnancies.
