he government has pulled the brand Larutan Cap Kaki Tiga (also known as Three Legs Cooling Water in Malaysia and Singapore) following a Supreme Court decision in response to a UK citizen’s lawsuit.
The court ruled in September in favor of UK citizen Russel Vince, finding that the brand's logo resembled Isle of Man's triskelion flag. Isle of Man or Mann is a self-governing "Crown dependency" located in the Irish Sea. Crown dependency are territories for which the UK is responsible.
The court instructed the Law and Human Right Ministry’s Intellectual Property Right Directorate General to pull the certificate and prohibit the use of the logo.
"Since Sept. 2, 2016, the brand had been pulled from the list," directorate spokesman Fatlurachman said in a press release on Tuesday.
“Cap Kaki Tiga” is a licensed product from Wen Ken Group Singapore made by PT Kino Indonesia. However, according to Vince's lawyer, Octavian Adhar, the court decision only affects the Indonesian market.
"The lawsuit is registered in Indonesia, not at Wen Ken Drug's headquarters in Singapore. Because our client saw the product is only distributed in Indonesia," Octavian said. (evi)
