he Supreme Court has rejected a petition to revise regulations on apartment management for the purpose of giving tenants more power over issues such as residential fees.
The regulations in question are a 2018 Public Works and Housing Ministry regulation and a 2018 gubernatorial regulation on the Owners and Tenants Association (P3SRS).
In a March 19 copy of the verdict obtained by kompas.com, a panel of judges consisting of Is Sudaryono, Yosran and Irfan Fachruddin rejected the petition filed by Pahala Sutrisno Amijoyo Tampubolon.
Governor Anies Baswedan confirmed the verdict, saying that he appreciated the decision.
"I appreciate that the [court] has made a decision based on the principle of justice,” he said on Friday while on a working visit to Thousand Islands regency.
“It means that our decision is constitutionally correct and in line with the principle of justice we want to push.”
Anies called on all stakeholders, particularly developers, to respect the decision and abide by the regulations.
The regulations stipulate that the management of apartments should be in the hands of its inhabitants, otherwise the administration would impose sanctions on developers that could include the revocation of their permits.
Conflicts between P3SRS members and tenants have occurred in the past, with tenants lambasting the P3SRS for not being transparent over building management fees. (fac)
