Reclamation or not: City struggles to win lawsuits

.The city administration previously filed an appeal with the PTTUN against the developer of islet I (PT Jaladri Kartika Pakci), which partnered with city-owned developer PT Pembangunan Jaya Ancol for the islet, and a cassation with the Supreme Court against the developer of islet H, PT Taman Harapan Indah, last year.

n his campaign during the Jakarta gubernatorial election in 2017, Anies Baswedan promised to stop the controversial reclamation projects in North Jakarta's coastal area.

Anies then voided the permits for the development of 13 artificial islets in September 2018 that eventually triggered developers to file lawsuits against him.

The legal process has not ended or produced a binding verdict since Anies has appealed to higher courts to overturn adverse rulings. Anies repeatedly said he would use any means to stop the reclamation projects.

The fact is the Jakarta administration had lost three out of four cases in the lower courts.

The latest development was on Jan. 22, when the Jakarta State Administrative High Court (PTTUN) rejected an appeal by PT Manggala Krida Yudha (the developer of Islet M) to challenge Anies' decision to revoke the permits for 13 reclaimed islets through Jakarta Gubernatorial Decree No. 1409/2018.

The panel of judges ruled the reclamation project of islet M must stop.

One day earlier, the Jakarta State Administrative Court (PTUN) ruled in favor of the developer of islet F (PT Agung Dinamika Perkasa), which had challenged the same decree. This developer collaborates with city-owned company PT Jakarta Propertindo for the islet.
