The House of Representatives has promised the nation that the long-stalled asset forfeiture bill will finally be passed by Dec. 15. To civil society advocates and a public exhausted by political corruption, the pledge arrived as a long-overdue victory.
But beneath this celebrated promise sits a sobering reality: the public has been handed a reform that was quietly rendered toothless months before its scheduled arrival.
More than two months before political leaders made their public pledge, President Prabowo Subianto quietly signed Law No. 4/ 2026 into force on June 17. Tucked inside this legislation is Article 50A, a clause granting absolute legal immunity to anyone purchasing "Patriot Bonds" or "Merah Putih Bonds", special debt instruments issued by Danantara.
The structural conflict is immediate and lethal. Between June 17 and Dec. 15, the state created a six-month "golden window." During this period, bad actors can legally convert questionable wealth into state-backed bonds. Once the asset forfeiture bill is enacted in December, it will run directly into the fundamental legal doctrine of nonretroactivity: a new law cannot retroactively confiscate assets that were legally immunized under prior legislation. By the time the House fulfills its promise to the nation, dirty capital will already sit safely behind an unassailable legal wall.
