Activists to report district judges' ruling to delay elections as ‘ethical breach’

Several civil society organizations and law firms have joined forces to tackle three district court judges who essentially ruled to delay the 2024 elections in a lawsuit brought by a minor political party.

A

coalition of civil society groups plans to file a report on a breach of ethics against three judges at the Central Jakarta District Court, following the Judicial Commission’s decision to investigate their controversial ruling that mandates restarting the 2024 election process.

The coalition includes the Indonesia Corruption Watch (ICW), the Center for Indonesian Law and Policy Studies (PSHK) and law firm Themis Indonesia.

“On Monday, we from Themis will visit the Judicial Commission to file a report against the [court’s] panel of judges for an ethics violation," Themis lawyer Ibnu Syamsu Hidayat said on Sunday.

Speaking at a press conference attended by representatives from various civil groups, including the ICW and the PSHK, Ibnu described the court’s ruling as “extraordinary” and that it flew in the face of how the law was supposed to work.

The ruling was made in a civil lawsuit filed by the newcomer Prima Party, which alleged that the General Elections Commission (KPU) had treated it unfairly during the registration and verification process for parties intending to take part in the 2024 elections. In its decision, the Central Jakarta District Court ordered the KPU to stop all ongoing election procedures and restart the process, dictating that it should take two years, four months and seven days.

Prima is one of five parties that did not pass the KPU’s verification process in November, making it ineligible to contest the 2024 general election.
