rosecutors in Bali have demanded prison terms and fines for two foreigners accused of attempting to smuggle drugs into the tourism destination in two separate cases.
The prosecution demanded a 12-year prison sentence for Ukrainian woman Kateryna Vakarova, who attempted to smuggle 2 kilograms of a new type of narcotic called 4-chloromethcathinone (4-CMC), also known as clephedrone, a synthetic stimulant drug of the cathinone class and classified as a new psychoactive substance (NPS).
Prosecutor Made Dipa Umbara told the panel of judges on Jan. 13 that all the facts revealed in the court showed that the defendant was legally and convincingly guilty of violating Article 112 of the 2009 Narcotics Law.
“We demand the panel of judges find the defendant Kateryna Vakarova legally and convincingly guilty for possessing, storing, controlling or providing more than 5 grams of a narcotic,” Dipa told Denpasar District Court.
In addition to demanding 12 years behind bars, the prosecutor also asked the panel of judges to impose a fine of Rp 1 billion (US$59,139), or 190 days’ extra imprisonment if the fine is not paid.
Dipa considered several factors in the demands, including that the defendant’s actions were counterproductive to the government’s efforts to eradicate drug use.
He also considered mitigating factors including that the defendant had demonstrated good behavior during the trial, confessed her crime and had shown remorse.
