Lawyers of ministry rape case victim to file pretrial motion

The rape victim identified only as N will have a legal team file a pretrial motion in an attempt to overturn a previous out-of-court settlement that saw the alleged perpetrators escape legal action.

A

legal-aid team representing a victim of rape at the Cooperatives and Small and Medium Enterprises (SMEs) Ministry is expected to file a pretrial motion in a last-ditch attempt to revive the case and overturn an out-of-court settlement that activists deemed grossly inadequate.

Pro-bono lawyers from the Legal Aid Foundation of the Indonesian Women’s Association (LBH APIK), which provides legal services to victims of sexual assault, will file a pretrial lawsuit against the Bogor Police for dropping rape charges on grounds of restorative justice – which benefited the alleged perpetrators but not their victim.

LBH APIK insisted that the settlement was not in accordance with the Criminal Code Procedures (KUHAP).

The victim’s legal team plans to file the motion this month.

The abuse took place in 2019 in an out-of-town meeting in Bogor, West Java, during which four ministry employees allegedly raped a contract staffer with the help of three other male colleagues. They took the victim to the crime scene and stood by the door to ensure no one interrupted.

The Bogor Police named the four alleged rapists suspects in early 2020 but dropped the charges that March, only to say they were released after settling out-of-court using a method of restorative justice.
